How Do I Sue A Non UK Company In UK?
Ryanair cancelled our return flight from Brno to London Stansted 3 hours after planned departure. We had to book expensive tickets with easyjet as their next day flight was full.
They refused to give us EUR 250 per person compensation granted by EU legislation claiming that a technical problem on their plane is out of their control. I tried to take them to small claims court but the claim was rejected as they are based in Ireland (outside UK).
Is there any UK based Ryanair office I can take to small claims court?
What is the other least expensive way to sue Ryanair Ireland?
Thanks for any tips.

If ireland are in the european union, i don’t see why you should not be able to sue them here. There is various eu treaties which allow for the jurisdiction in cases to be heard in the uk, or where the substantial performance was to take. In this case performance was to be completed in the uk? Search for Rome Convention and Brussels II (44/2001) for further guidance this is a tricky area, a decent lawyer should be able to give you an hours worth of advice for a reasonable sum.
Forget EU compensation amount, you should be able to sue for repudiatory breach of contract ie non performance.
The guy above, has a good idea, you could avoid hassle and perhaps claim from your credit card company if the transactions are over £100.
I cant give you a direct answer, but I can suggest something.
Write to their legal department explaining the situation, and ask them what legal course you may pursue in order to get the compensation you are entitled to.
Legal representatives are not allowed to lie in their response, and thus they should pretty much give you the advice you need. Send it by recorded post, so they cannot deny receiving it.
I assume you would have to sue in the world court and for that you need a lawyer, a VERY EXPENSIVE lawyer.
You should be able to as Ryanair is still a EU Company. Check out Company’s House in London to see where they are registered.
You could always tell them that there on a "Yahoo" Site and millions see what you and others are saying … that may get a reaction..!!
Good Luck.
Foreing Companys doing bussiness in any Country outside of theirs, are bound to the laws of the Foreign Country.
Check to see if had it been a UK Company that did what they did to you, what their liability would have been in this case, then go to the Better Bussiness Bureau with your complaint.
You may not need a lawyer.
I would suggest the small claims court was wrong in law, there has been a court decision that says you can sue a non-uk company if the contract was formed in the uk, i.e. did you buy the tickets here (internet, telephone or travel agents) if so then subject to uk law!
However, the defence given by Ryanair is a total defence, i.e. technical problem beyond their knowledge and control thus not much point in making the claim anyway!
If you have not had a refund and paid by credit card then under s.75 Consumer Credit Act you can seek the refund from the card company.
